Drinks producers and hospitality operators have called for the Scottish Government to pause and revise the Deposit Return Scheme which is due to come into force in August 2023. More than 500 business people have signed an open letter to Lorna Slater, MSP, due to concern that in its current format it is not viable.
The open letter has been published in The Scotsman only a day after Circularity Scotland, the scheme administrator for the Deposit Return Scheme in Scotland, welcomed new guidance from the Scottish Government which will significantly reduce the cost of the scheme for industry and consumers.
These changes will reduce the overall cost of the scheme and allow Circularity Scotland to recalculate the cost per container that each producer is required to pay to meet their obligations under the scheme. CSL will be providing further information to producers on this in the coming weeks.
However there are concerns right across the board regarding the current format of the scheme, which will have a major impact and cost-implications for the off-trade, drinks producers as well as the on-trade.
The open letter was set in motion by whisky consultant Blair Bowman and quickly gathered momentum with more than 500 signatures ranging from producers such as Innis & Gunn and Wemyss Family Spirits to pub companies including Punch and Greene King as wells as operators including Donald Macleod of Holdfast, Scott Murray of Cru Holdings and Kenny Blair of Buzzworks.
The letter concludes, “For the proposed DRS to be a success rather than a high-profile failure, we (industry) need our concerns to be heard. We invite the Scottish Government to engage with us to review the considerable risks and challenges mentioned. By working in partnership we can redesign a viable scheme that moves successfully towards a circular economy.”
Blair Bowman said, “If we’re to avoid the catastrophic impact of the DRS then Lorna Slater needs to press pause now, and meet with our industries and the UK Government to come up with a sustainable solution that will benefit people and the planet.
“With less than a year to go until the DRS is supposed to be introduced, tens of thousands of companies that produce, distribute, and sell drinks are being left in the dark about how they can adapt their businesses to cope with these heavy-handed regulations.
“When I talk to many small businesses, they’re scared about how the DRS is going to affect their trade.
“What’s even more worrying is that some companies don’t even know that the scheme is coming because there’s been so little communication from the Scottish Government – it’s like the UK Government’s mishandling of Brexit rule changes all over again.”

Urgent demand from Scottish businesses to pause, revise and redesign the Deposit Return Scheme
Dear Ms. Lorna Slater, MSP,
We, the undersigned, propose the Deposit Return Scheme be paused, revised and rewritten. We request that the Scottish Government recognises the considerable concerns and risks raised by multiple sectors across Scotland of the impending catastrophic impact the scheme will impose on both businesses and consumers. We suggest a collaborative effort between industry and the Scottish Government to design a sustainable system that will function successfully for producers, hospitality businesses and consumers, whilst positively reducing the carbon footprint.
Outline of the proposed Deposit Return Scheme:
The Scottish Government is introducing one of the most environmentally ambitious, yet complex Deposit Refund Scheme (DRS) in Europe, scheduled to go live in August 2023. The scheme applies a standardised 20p deposit to all drink containers (glass, metal or PET between 50ml and three litres) to be refunded to the consumer when they return the empty in-tact container to any one of 35,000 collection points – be it over the counter, via a reverse vending machine (RVM) or an online retailer.
The onus is on consumer behaviour to drive circularity, however the producers will be held responsible for every container they put on the market. The small number of industry bodies who know of the scheme have openly expressed their grave concerns about the serious detrimental consequences it will have on tens of thousands of businesses. Chief among these is the drinks and hospitality sector, as well as local councils and retailers. Not to mention the obvious damaging impact on consumer spending choice.
As industry members we are fully supportive of initiatives intended to deliver on circularity and net zero. Many of us have invested in new systems and processes to reduce our carbon footprint. We actively encourage new initiatives that are realistic and aligned to our best operating practices.
The key flaws of DRS:
There are many damaging consequences that would affect the entire supply chain should the scheme go ahead. For the purpose of this letter we are focusing on those we consider the key flaws:
● Risk of fraud. Legitimate online sales will become unviable due to the takeback obligation, leaving the door wide open to a black market. Does SEPA have the resources to police the hundreds of small online retailers that now exist in Scotland and the rest of the UK?
● Major losses in consumer spend. An unintended consequence of the scheme could encourage fraudulent behaviour in the form of ‘’booze trips’ across the border. According to SBPA “Products on sale in the north of England without deposits will result in the price at the point of purchase for multipacks being 50% cheaper than in Scotland.” Our English neighbours would experience a sharp rise in drink revenue as Scotland suffers a steady decline. Is it not the Scottish Government’s best intention to boost our economy?
● Loss of investment in the Scottish economy. The integrated UK supply-chain and single market for drinks containers would change if the DRS scheme is launched only in Scotland. The different requirements would potentially create separate markets. This leads to high administrative costs which many small businesses will be unable to meet resulting in permanent closures. Larger businesses and producers may view the Scottish market as less appealing for investment purposes. We would urge a collaboration between the Scottish and UK Governments to align the start date of a UK wide scheme, maintaining the benefits of a single market.
● Financial and environmental implications for local authorities: No DRS schemes have been introduced in Europe where there is established kerbside recycling. In Scotland, kerbside recycling relies on the value of recyclates. This will be reduced when the DRS separates food and beverage containers into two waste streams, creating a further issue for local authorities locked in to longer-term waste disposal contracts. In addition, local authorities have fine-tuned their collections to optimise routes. It’s unknown what the carbon impact will be when they are remodelled to take account of changed recycling. Local authorities would require increased transport and collection fleets to comply with the DRS pick-ups and sorting from the 35,000 take-back points, increasing our carbon footprint. Is this not in contradiction to the purpose of the DRS?
Our proposal to pause the launch of DRS:
The DRS is being proposed after two years of extremely tough trading through Covid and Brexit. Further exacerbated by the current supply chain impacts from the war in Ukraine, rising energy costs, business costs and costs of living. Many would agree the timing is not ideal.
For the scheme to be practical consumers would first need to be informed and fully understand its premise. This highlights an obvious need for educational campaigns and resources, but not just on a national level. In 2019 (VS) there were 14.1million overnight visits to Scotland, of which 3.5million were international visitors. Who will be accountable for informing visitors of the DRS and justifying the hike in price points compared to the UK market? Will visitors be expected to return their own containers to recycling points? The health of our economy relies heavily on tourism and hospitality. Have these points been considered?
Tens of thousands of businesses who produce, can, bottle, distribute, or sell alcoholic or soft drinks in Scotland now have less than a year to successfully adapt their operations, without the necessary knowledge or levers in place.
